The green card system was established in 1949 on the basis of the recommendation of the UN Economic Commission for Europe (UNECE) (Recommendation No. 5 approved by the Working Group on road transport of the UN Economic Commission for Europe) and began to be applied on January 1, 1953.
The green card system is an agreement on the mutual recognition of a certificate of civil liability insurance of motor vehicle owners between the participants of this system, that is, member countries. According to this system, the insurance certificate of civil liability of motor vehicle owners issued by any of the states participating in the “green card” agreement is considered valid in the territory of other states participating in this Agreement. Currently, 48 countries are members of the system.
The main purpose of the system is to ensure that the civil liability of foreign motor vehicle owners visiting any country that is a member of it is compensated for the damage caused as a result of traffic accidents in the countries they travel to by insuring them in accordance with the national legislation of the country to which they belong. For these purposes, on the basis of mutual guarantee of the bureaus that are members of the system, a single security system is organized – "green card", which insures the civil liability of drivers traveling to foreign countries on motor vehicles during the trip. Consequently, getting a "green card" from insurers in their country by means of motor transport to foreign countries covered by the system implies full insurance of their civil liability for the entire trip and exempts them from the requirement to purchase new civil liability insurance at the border of each foreign country they visit.
Within the framework of the” green card " system, green card bureaus were established in each of the member countries in order to compensate for the damage caused. These bureaus provide a guarantee that the compensation for damages caused to third parties who were injured or whose property was damaged as a result of a traffic accident caused by foreign motor vehicle drivers will be covered by insurance payment in the country where the incident occurred. Then, the green card bureaus of the country where the incident occurred have the right to compensate the amount of insurance payments paid from the green card Bureau of the country to which the green card holder driver belongs.
The Compulsory Insurance Bureau of the Republic of Azerbaijan first submitted a request for membership in the Green Card system in 2012. This survey was initially given a positive opinion and familiarized with the legal and other requirements considered necessary for the bureaus wishing to become members of the system.
It should be noted that relevant amendments were made to the law of the Republic of Azerbaijan “on compulsory insurance” and these changes entered into force on December 25, 2014. According to the amendments to the law of the Republic of Azerbaijan” on compulsory insurance " dated November 28, 2014, new provisions have been added to the law regarding Azerbaijan's accession to the Green Card system. According to these changes, from January 2016, 1, it is planned to introduce the Green Card system in Azerbaijan.
